The Preamble of the Code of Ethics states that we should "...identify and take steps, through enforcement of this Code of Ethics and by assisting appropriate regulatory bodies, to eliminate practices which may damage the public or which might discredit or bring dishonor to the real estate profession."

The following information will assist you in filing a Disciplinary Complaint. If you need help or have other questions, contact SCCAR at 831-464-2000 or by email .

In order for the Association's Grievance Committee to review the complaint for an alleged ethics or MLS violation, Grievance Complaint form (D-1) must be completed and returned to the Association.

In filling out the forms please note the following:
  1. Write in your name as the complainant
  2. Write in the name(s) of the respondent (the person against whom the complaint is made). You may include the name of the Responsible Broker or Participant for an alleged violation of the Code of Ethics and or violation of the MLS Rules & Regulations.
  3. Be sure to specify which violation(s) of the Code of Ethics or Section(s) of the MLS Rules you are citing by entering the Article(s) and/or MLS Section(s) number(s). In identifying the item(s) please read the Articles and/or MLS Section(s) carefully.
  4. Attach a typed statement of the facts and circumstances that support your allegations; this will be marked "Exhibit 1". You may attach other supporting documents to your statement.
  5. Answer the remaining questions on the form.
  6. There is no fee for filing an ethics or grievance complaint. If a hearing panel determines a violation has occurred, the Respondent(s) will be assessed a $500 administrative fee.
Once all the necessary information is received by the Association, it will be reviewed by the Grievance Committee. You will be notified by mail of their determination as to whether or not a formal hearing will be scheduled.
